In a lengthy opinion available here, Judge Martini in the In re Human Tissue Products Liability Litigation MDL has ruled the plaintiffs’ expert causation opinions (including the ubiquitous Suzanne Parisian, M.D.) inadmissible under Daubert with respect to the most serious diseases at issue in the litigation (HIV, hepatitis B&C, syphilis, prion disease, and cancer), and has granted partial summary judgment. Lots of good stuff about extrapolation.
