We are pleased to report that the proposed ABA Resolution 105 – first blogged about here – has been withdrawn and will not be an issue at the House of Delegates session at the upcoming ABA meeting. The originators chose to withdraw it in the face of opposition from “several ABA entities and individual leaders within the ABA.” We know that this opposition included the Litigation Section’s Product Liability Committee, the TIPS Section, and the Section of Science & Technology Law. We heard that other ABA committees were also preparing oppositions.
A lot of defense groups were also heard from. We at the DDL Blog thank everyone who participated in the effort to head off this destructive and extremely biased proposal.
